Stiff Penalty?

The widow of a man who died in 2007 has been given a 6 month jail term after pretending her husband was still alive and had been at the wheel of their car in 2008! She would have been sent a Section 172 Notice as to who the driver was on the two speeding occasions and she claimed it was down to her hubby. She pleaded guilty to Perverting the course of Justice at Derby Crown Court. To compound her deception she tried applying for a passport in his name, using a photo of a man she met in Spain.

We have represented a number of drivers who stupidly get involved in transferring points, only to find that they are facing an immediate sentence of imprisonment rather than just points on the licence and a fine. This conduct often occurs when the driver is facing disqualification under the Totting-up provisions, namely 12 or more points within 3 years.
