R vs. J - Guildford Crown Court - Rape

We represented a 25-year-old client who was the cousin of the 13-year-old complainant. She alleged she had been raped by him during an overnight stay at a friend's house.

Our client’s case was that the complainant had fabricated the entire incident. Prosecution DNA expert gave evidence was that the complainant's DNA had been found on the inside front of the defendant's boxer shorts. Our own forensic expert gave evidence that the presence of DNA may have been the result of secondary transfer. The jury deliberated and found our client not guilty.
